Welcome to RV Trader (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and marketplace (the “Site” or “Services”). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Site.

1. About RV Trader
   We provide an online marketplace that allows sellers to advertise items, vehicles, property, jobs, and services (collectively, “Items”).

We are not a party to any transaction between buyers and sellers. We do not buy, sell, own, inspect, or guarantee any Items listed on the Site, and we do not act as an agent for either buyers or sellers.

All transactions and agreements are made solely between the buyer and the seller.

2. Eligibility and Accounts
   By using the Site, you confirm that you are legally able to enter into binding contracts under New Zealand law.

You are responsible for maintaining the confidentiality of your account details and for all activity that occurs under your account.

3. Listings
   3.1 Accuracy of Listings
   All Listings must be accurate, current, complete, and not misleading. Listings must include all relevant information and key terms, including:

An honest and clear description of the Item
The sale price and payment terms
Delivery or shipping arrangements
Who is responsible for shipping or delivery costs
3.2 Seller Responsibility
If you use any RV trader tools or third-party tools to assist with creating a Listing, you remain fully responsible for the legality, accuracy, completeness, and relevance of the Listing.

You may only list Items that you own or have the legal right to sell, unless we have approved otherwise in writing.

If an Item is likely to attract customs duty or import charges for New Zealand buyers, this must be clearly disclosed in the Listing.

4. Legal Compliance
   All Listings and use of the Site must comply with all applicable laws and regulations. This includes ensuring that:

You have the legal right to create the Listing
Ownership of the Item is not disputed (for example, due to relationship property or legal disputes)
Listings are truthful and do not omit material information
The Item or service can legally be sold or supplied
Any applicable safety or compliance standards are met
We may remove or restrict access to Listings that breach legal requirements.

5. Acceptable Use of Services
   You must use RV Trader Services only for their intended purpose.

For example, a Classified Listing for a vehicle is intended to advertise one specific vehicle for sale. You must not misuse the Site to:

Avoid or circumvent fees
Advertise unrelated businesses or services
Manipulate search results, rankings, or visibility
We reserve the right to remove Listings or restrict accounts that misuse the platform.

6. Fees and Payments
   Fees for Listings or Services will be disclosed at the time of purchase or use. All fees are non-refundable unless otherwise stated. All fees include GST.

You are responsible for all costs associated with creating Listings and completing transactions.

7. GST and Tax Obligations
   7.1 New Zealand Sellers
   If you are GST-registered and are New Zealand-based, or are a tax resident of New Zealand for GST purposes, you must:

List Items in New Zealand dollars (NZD)
Include GST (if applicable) in the listed price
Dealers listing through the dealer portal may be permitted to display GST-exclusive pricing.

7.2 Non-Resident Sellers
If you are a non-resident for New Zealand GST purposes, you must notify us and provide GST-exclusive prices. Where required, Boat Market will add GST to Listings and remit GST to Inland Revenue.

You must notify us promptly if your GST residency status changes.

7.3 Australian Buyers
In limited circumstances where an Item is purchased by an Australian resident, we may manage Australian GST obligations.

8. Content and Intellectual Property
   All content on the Site, including text, graphics, logos, and software, is owned by or licensed to Boat Market and is protected by intellectual property laws.

You must not copy, reproduce, or use any Site content without our prior written consent, except as permitted by law.

9. Limitation of Liability
   To the maximum extent permitted by law, RV Trader is not liable for any loss, damage, or dispute arising from:

Listings or Items advertised on the Site
Transactions between buyers and sellers
Inaccurate or misleading Listings
Delays, failures, or interruptions of the Site
Your use of the Site is at your own risk.

10. Indemnity
    You agree to indemnify and hold Boat Market harmless from any claims, losses, damages, liabilities, or expenses arising out of your use of the Site, your Listings, or your breach of these Terms.
11. Suspension and Termination
    We may suspend or terminate your account or access to the Site at any time if we believe you have breached these Terms or misused the Services.
12. Changes to These Terms
    We may update these Terms from time to time. Updated Terms will be posted on the Site and take effect from the date stated. Your continued use of the Site constitutes acceptance of the updated Terms.
13. Governing Law
    These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
